Terms and Conditions (T&Cs)

1. The T&Cs shall govern a series of Contests, commencing daily at [12:00 AM] and concluding at [12:00 PM] each and every day, scheduled to run from April 23rd 2024 till May 26th 2024. Each of these contests are hereinafter collectively called as “Contests” and individually each contest is referred to as “Contest”.

 

2. These series of Contests are being organized by Walko QSR Company Private limited (hereinafter referred to as “NIC Honestly Crafted Ice Creams”) conducted on www.swiggy.com and its mobile application (“Intermediary Platform”)/ or “Swiggy”. . Your use of the ‘Swiggy’ mobile application and/or the website (“Swiggy App”) and participation in the Contest affirms (i) your acceptance of these  terms and conditions (including the terms of use accessible at https://www.swiggy.com/terms-and-conditions) (collectively the “Terms”) and (ii) your confirmation that you meet all eligibility criteria for participation.

 

3. Participants expressly acknowledge and agree to be bound by these T&Cs together with any specific instructions provided additionally and supplementary to the T&Cs.  Such instructions may be communicated through electronic communication, website postings, or any other mode of communication. Participants affirm their voluntary participation, full consent, and exercise of their own free will in accordance with these terms.

 

4. Each Contest shall mean participation as per terms and conditions herein through ordering NIC Honestly crafted Ice-cream from Intermediary Platform, for winning 1 (one) Mumbai Indian Merchandize per winner in each Contest.

 

5. Any entry received for each Contest after 12:00 AM as stipulated hereinabove under Clause 1 will be invalid for that particular Contest. However, such entries may be considered for the aforesaid successive Contests.

 

6. To participate in each round of Contest, the participant must follow the following steps:

 

1.   Purchase Requirement: the participant(s) must purchase any NIC Honestly Crafted ice-creams from any available/ listed and operational store(s) in the Intermediary Platform during the timeline of respective Contest;

 

1.   give 2 (two) of correct answer(s) as communicated at the time of Contest to be conducted by NIC Honestly Crafted Ice-creams.

 

1.     The Participants eligible to participate in the Contest will be notified either through a phone call or text messages/SMS by NIC Honestly Crafted Ice-creams.

 

The Intermediary Platform will maintain the database of each participants correct answers to the question(s) of the Contest conducted by NIC Honestly Crafted Ice-Cream

1.   Any entry of purchase order(s) by an individual who has previously won any Contest may stand to be ineligible to participate in the subsequent Contests.

 

7.   The winner(s) for each Contest will be selected from the pool of entries submitted by participants who had submitted the correct answer in the relevant Contest provided by the Intermediary Platform.

 

8.   The top 10 (ten) participants selected from the pool of correct entries using an automatic random selection software will be chosen as winners of that Contest.

 

9. Each winner will be rewarded with 1 (one) ‘Mumbai Indians’ merchandize post the expiry of the contest end time of the relevant Contest. The Winners of each Contest will be notified via electronic communication on the mobile number provided during the billing, within 48 working hours after End time of the respective Contest.

 

10. Winners are required to confirm their acceptance of the reward and submit the address for delivery of the reward within 24 hours of the declaration by NIC Honestly Crafted Ice-cream. In the event of failure to provide consent or their address within this timeframe shall be construed as rejection or denial of the rewards by the winner.  Consequently, the reward will be granted to the next individual who placed the purchase order with highest value on the Intermediary Platform.

 

11. The rewards shall be dispatched to the address provided by the winners in accordance with clause 10. In the event any winner(s) submitting inaccurate or incorrect address of any wrong or incorrect address NIC Honestly crafted Ice-cream shall not be liable for any costs or arrangements associated with re-delivery or failed delivery attempts. Upon receipt of the address by the winner(s) the reward shall be dispatched within 60 days by NIC Honestly crafted Ice-cream.

 

12. The T&Cs of the Contests are subject to the laws of India and any dispute arising out of these Contests is subject to exclusive jurisdiction of the courts at Pune, Maharashtra.

 

13. An independent third-party auditor will assess, oversee and validate the process for determining the winner. The independent third party auditor shall ensure that the winner(s) is selected in the fairest and most transparent  manner by NIC Honestly Crafted Ice Cream.

 

14. NIC Honestly Crafted Ice Cream shall not be held liable for any errors, faults, or actions of the Intermediary Platform concerning the purchase orders or the rewards. The Intermediary Platform functions as a platform for facilitating transactions, and any issues arising from the purchase process or the rewards themselves are the sole responsibility of the Intermediary. NIC Honestly Crafted Ice Cream assumes no responsibility for any shortcomings, delays, defect, errors or authenticity issues occurring during the purchase process or during the delivery of the reward(s). Users acknowledge and agree that any disputes or claims arising from transactions made through the Intermediary Platform shall be solely between the user and the Intermediary Platform, and NIC Honestly Crafted Ice Cream shall not be a party to such disputes or claims.

 

1. Intermediary Platform makes no promise nor provides any warranty with respect to the utility, merchantability or fitness of the prize and everything regarding the Prize or the Contest, including the prize, is provided on an “as is” basis. Swiggy and its affiliates, agents and representatives are not responsible for any loss, injury, or any other liability arising due to the Participant’s participation in the Contest whether direct or indirect.

16. The Contest is being conducted by NIC and the winners of the Contest will be decided by the NIC, Swiggy and its affiliates, agents and representatives shall have no direct or indirect liability towards the participants of the Contest with respect to their participation in the Contest. The contestant shall have no claim against Swiggy with respect to any dispute regarding fulfilment of the Contest and awarding the Prize

1. Swiggy does not make any commitment, express or implied, to respond to any feedback, suggestion given by the Participant and, or, their queries.

 

 

18. NIC Honestly Crafted Ice Cream’s decision with respect to all matters pertaining to these Contests will be final and binding upon the participants. No correspondence will be entertained into about the Contests or the decision concerning the winner.

 

19. NIC Honestly Crafted Ice Cream at any time reserves the right to disqualify the participants and/or revoke the prize if the participants breach any of these terms and conditions or other rules and regulations of these Contests or violate any applicable laws or regulations.

 

20. The rewards offered in these Contests are not transferable and not redeemable for cash. NIC Honestly Crafted Ice Cream is not responsible for the service and support with regard to the Mumbai Indians home match experience of the winner(s)

 

21. If the prize is declined, unclaimed, or unable to be claimed, or if a winner cannot be contacted from the details provided, NIC Honestly Crafted Ice Cream may select the next winner by using automatic random selection software from the pool of entry received who provided the correct answer.

 

22. By participating in the Contest, each participant acknowledges and agrees that all entries, including any associated copyright and other intellectual property rights, become the exclusive property of NIC Honestly Crafted Ice Cream.
23. NIC Honestly Crafted Ice Cream reserves the right to amend or discontinue any of the Contest and/or its terms and conditions, at its sole discretion without the requirement of giving any prior notice.

 

24. NIC Honestly Crafted Ice Cream shall not be liable for any cost incurred by the participants in participating in the Contest.

 

1. Swiggy may collect personal information from the contestant at any time during the participation and winner selection process for the purposes of verifying the contestant’s identity, facilitating the award of the Prize to the contestant in case he/she is declared a winner. It will also share the information with NIC for conducting the quiz and for the purpose of facilitating the award of the Prize to Contestant in case he/she is declared a winner. Participant consents to providing such information to Swiggy and NIC, use of such information by Swiggy and NIC  and  their respective representatives or agents engaged by them in the course of the Contest as well as publication of Participant’s full name and city of residence, personal description, likeness and opinion on Swiggy’s own websites and apps as well as their respective social media channels, including but not limited to Twitter and Instagram for the purposes of promotion of the Contest and declaration of winners of the Contest.

 

1. Participant agrees and acknowledges that his/her participation in the Campaign is entirely voluntary. This Campaign is not intended to be and shall not be construed to be advice, invitation or solicitation to purchase any products and/or services of Swiggy or any third party.

 

1. Participant agrees and acknowledges that his/her participation in the Campaign does not create any rights whatsoever in his/her favour with respect to the use of any intellectual property belonging to Swiggy and/or its affiliates, including without limit, their respective names, branding and trademarks (registered or unregistered). Participant agrees not to use any such intellectual property in any manner that is not consented to in writing by the respective owner thereof.  

 

 

 

28. NIC Honestly Crafted Ice Cream and Intermediary Platform shall not be liable for any match cancellation or any damage or loss caused as a result of cancellation/amendment of any Contest or Mumbai Indians home match, amendment or revocation of all or part of these terms and conditions, any act of God event , governmental action or other force majeure circumstances (or any event beyond the control of the NIC Honestly Crafted Ice Cream and Intermediary Platform) during the Mumbai Indians home match.

 

29. Individual who are currently employed, contracted, serving as officers, directors, representatives, or agents of NIC Honestly Crafted Ice-cream or any of its affiliated entities, as well as members of their immediate families or households, are ineligible to participate or claim any prize awarded in connection with this contest.

 

30. The participants shall indemnify NIC Honestly Crafted Ice Cream Intermediary Platform against any and all claims, penalties, losses, damages, liabilities, costs or expenses  arising out of or connected with the following (i) breach of these Terms and Conditions by the participants; (ii) disparagement of NIC Honestly Crafted Ice Cream’s image or Swiggy’s image by Participant as the case maybe and/or (iii)any third party claim for infringement of intellectual property rights.

This Contest is being organized by Walko QSR Company Private limited (hereinafter referred to as “NIC Honestly Crafted Ice Creams”) conducted on www.swiggy.com and its mobile application (“Intermediary Platform”)/or “Swiggy”.  Your use of the ‘Swiggy’ mobile application and/or the website (“Swiggy App”) and participation in the Contest affirms (i) your acceptance of these  terms and conditions (including the terms of use accessible at https://www.swiggy.com/terms-and-conditions) (collectively the “Terms”) and (ii) your confirmation that you meet all eligibility criteria for participation. 
3. The Contest shall mean participation as per terms and conditions herein through ordering NIC Honestly crafted Ice-cream from Intermediary Platform, to be eligible for winning ‘Mumbai Indian’ merchandise digitally signed by a player of the Mumbai Indian team.
4. The total number of merchandises to be distributed as reward in this Contest are 2 (two). Each winner will be rewarded with 1 (one) ‘Mumbai Indians’ merchandise digitally signed by one of the Mumbai Indian players post the expiry of this Contest.

 

 

5. Participants expressly acknowledge and agree to be bound by these T&Cs together with any specific instructions provided additionally and supplementary to the T&Cs.  Such instructions may be communicated through electronic communication, website postings, or any other mode of communication. Participants affirm their voluntary participation, full consent, and exercise of their own free will in accordance with these terms.
6. Any purchase made after [end time] of May 26th, 2024 as stipulated hereinabove under Clause 1 will be invalid for that particular Contest.
7. To be eligible to take part in the Contest, the participant must be an Indian citizen, evidenced by their Aadhar Card. To participate in each round of Contest, the participant must follow the following steps:
8.     Purchase Requirement: the participant(s) must purchase any NIC Honestly Crafted ice-creams from any store(s) on the Intermediary Platform during the timeline of respective Contest and shall also answer at least 2 questions in the quiz conducted by NIC;
9.     The winner(s) for the Contest will be selected from the participants who answer such number of questions correctly as communicated at the time of quiz to be conducted by NIC.
10. The winner(s) the Contest will be selected using an automated random selection  software from the pool of entries comprising of purchase orders of NIC Honestly crafted Ice-cream made during the respective Contest timeline and who have given the correct answers to the quiz conducted by NIC. 
11. In the event the number of participants with the correct answers in the Contest  exceeds 1 (one), then upto top 2 (two) winners will be selected from such list of entries using an automated random selection software.
12. The Winner(s) of this Contest will be notified via electronic communication on the mobile number provided during the billing, 72 hours after conclusion of the Contest as stipulated in Clause 1.

 

 

11. Winners are required to confirm their acceptance of the reward and submit the address for delivery of the reward within 24 hours of the declaration by NIC Honestly Crafted Ice-cream. In the event of failure to provide consent or their address within this timeframe shall be construed as rejection or denial of the rewards by the winner.  Consequently, the reward will be granted to the next individual who placed the purchaser order maximum number of times on the Intermediary Platform during the stipulated timeline.

 

12. The rewards shall be dispatched to the address provided by the winners in accordance with clause 11. In the event any winner(s) submitting inaccurate or incorrect address of any wrong or incorrect address NIC Honestly crafted Ice-cream shall not be liable for any costs or arrangements associated with re-delivery or failed delivery attempts. NIC Honestly Crafted Ice Cream assumes no responsibility for any shortcomings, delays, defect, errors or authenticity issues occurring during the purchase process Users acknowledge and agree that any disputes or claims arising from transactions made through the Intermediary Platform shall be solely between the user and the Intermediary Platform, and NIC Honestly Crafted Ice Cream shall not be a party to such disputes or claims.

Your use of the ‘Swiggy’ mobile application and/or the website (“Swiggy App”) and participation in the Contest affirms (i) your acceptance of these  terms and conditions (including the terms of use accessible at https://www.swiggy.com/terms-and-conditions) (collectively the “Terms”) and (ii) your confirmation that you meet all eligibility criteria for participation.

4.     Each Contest shall mean participation as per terms and conditions herein through ordering NIC Honestly crafted Ice-cream from Intermediary Platform, for winning Two Stand Ticket per winner for the upcoming Mumbai Indians home match at Wankhede Stadium, Mumbai in the Indian Premier league 2024 edition in each Contest.

 

5.     Any entry received for each Contest after the End Date and Time as stipulated hereinabove under Clause 1 will be invalid for that particular Contest. However, such entries may be considered for the aforesaid successive Contests.

 

6.     To be eligible to take part in  each Contest, the participant must be an Indian citizen, evidenced by their Aadhar Card. To participate in each round of Contest, the participant must follow the following steps:

 

1. Purchase Requirement: the participant(s) must purchase any NIC Honestly Crafted ice-creams from any available store(s) in the Intermediary Platform during the timeline of respective Contest;

8.     In the event the number of participants with the correct number of answers exceeds 2 (two), then the top 2 (two) winners will be selected from such a pool of entries using an automated random selection software for the relevant Contest.

 

9.     Each winner of a Contest will be rewarded with 2 (two) Tickets for the ‘Mumbai Indians’ home matches at Wankhede Stadium, Mumbai post the expiry of the contest End date and time of the relevant Contest. The Winners of each Contest will be notified via electronic communication on the mobile number provided during the billing, within 24 working hours after the End Date of the respective Contest. The reward is subject to the following conditions:
10. Ticket type: General Stand Ticket for Mumbai Indians home match at Wankhede Stadium only;
11. The ticket is only valid for the Mumbai Indians home match that the respective Contest has been won for;
12. This match ticket will not be valid for other matches than the Mumbai Indians home  match;
13. The reward includes only the Mumbai Indians home match ticket and excludes  travel expenses, accommodation expenses, incidentals, or any other associated costs of the winner. 
14.   The T&Cs of the Contests are subject to the laws of India and any dispute arising out of these Contests is subject to exclusive jurisdiction of the courts at Pune, Maharashtra.

In the event of failure to provide consent, it shall be deemed as rejection or denial of the rewards by the winner, and the reward will be granted to the next individual who made the highest purchase on the Intermediary Platform. The winners shall collect the physical tickets from a NIC Ice Cream Parlour/outlet located at 33rd Road Street, Linking Road, Link Square Mall, opposite KFC, Bandra West, Maharashtra – 400050.

Intermediary Platform makes no promise nor provides any warranty with respect to the utility, merchantability or fitness of the prize and everything regarding the Prize or the Contest, including the prize, is provided on an “as is” basis. Users acknowledge and agree that any disputes or claims arising from transactions made through the Intermediary Platform shall be solely between the user and the Intermediary Platform, and NIC Honestly Crafted Ice Cream shall not be a party to such disputes or claims

20.   If the prize is declined, unclaimed, or unable to be claimed, or if a winner cannot be contacted from the details provided, NIC Honestly Crafted Ice Cream may select the next winner by using automatic random selection software from the pool of entry received who provided the correct answer.
21.   By participating in the Contest, each participant acknowledges and agrees that all entries, including any associated copyright and other intellectual property rights, become the exclusive property of NIC Honestly Crafted Ice Cream.
22.   NIC Honestly Crafted Ice Cream reserves the right to amend or discontinue any of the Contest and/or its terms and conditions, at its sole discretion without the requirement of giving any prior notice.

1. Swiggy may collect personal information from the contestant at any time during the participation and winner selection process for the purposes of verifying contestant’s identity, facilitating the award of the Prize to the contestant in case he/she is declared a winner. It will also share the information with NIC for  conducting the quiz and for the purpose of facilitating the award of the Prize to Contestant in case he/she is declared a winner. Participant consents to providing such information to Swiggy and NIC, use of such information by Swiggy and NIC  and  their respective representatives or agents engaged by them in the course of the Contest as well as publication of Participant’s full name and city of residence, personal description, likeness and opinion on Swiggy’s own websites and apps as well as their respective social media channels, including but not limited to Twitter and Instagram for the purposes of promotion of the Contest and declaration of winners of the Contest.

 

1. Participant agrees and acknowledges that his/her participation in the Campaign is entirely voluntary. This Campaign is not intended to be and shall not be construed to be advice, invitation or solicitation to purchase any products and/or services of Swiggy or any third party.

Participant agrees and acknowledges that his/her participation in the Campaign does not create any rights whatsoever in his/her favour with respect to the use of any intellectual property belonging to Swiggy and/or its affiliates, including without limit, their respective names, branding and trademarks (registered or unregistered). Participant agrees not to use any such intellectual property in any manner that is not consented to in writing by the respective owner thereof.  

26.   NIC Honestly Crafted Ice Cream or Intermediary Platform shall not be liable for any cost incurred by the participants in participating in the Contest.
27.   NIC Honestly Crafted Ice Cream and Intermediary Platform shall not be liable for any match cancellation or any damage or loss caused as a result of cancellation/amendment of any Contest or Mumbai Indians home match, amendment or revocation of all or part of these terms and conditions, any act of God event , governmental action or other force majeure circumstances (or any event beyond the control of the NIC Honestly Crafted Ice Cream of Intermediary Platform) during the Mumbai Indians home match.

 

28.   Individuals who are currently employed, contracted, serving as officers, directors, representatives, or agents of NIC Honestly Crafted Ice cream or any of its affiliated entities, as well as members of their immediate families or households, are ineligible to participate or claim any prize awarded in connection with this contest.

 

29.   The participants shall indemnify NIC Honestly Crafted Ice Cream and Intermediary Platform against any and all claims, penalties, losses, damages, liabilities, costs or expenses  arising out of or connected with the following (i) breach of these Terms and Conditions by the participants; (ii) disparagement of NIC Honestly Crafted Ice Cream’s image or Swiggy’ image by Participant and/or (iii)any third party claim for infringement of intellectual property rights.
